Provincial Offences Advocacy

A Provincial Offence is commenced by one of two ways. (1) Either you receive a ticket. This ticket will have a dollar value amount on the front of it and the officer's name appears at the top (just below a 4 digit number and an 8 digit number). Or, (2) you may receive a summons. This document looks like a ticket only it does not have a dollar value. Instead, it has a date, time and place where you are "commanded by Her Majesty" to appear in Court.

If you want Ontario, Toronto or Ottawa Traffic Ticket Defence you have to contest your ticket, you need to follow the instructions on the rear of the ticket which usually involves bringing it into the local court office where the offence is alleged to have occurred (some locations allow you to mail it in, although many do not). If you pay the ticket, or if you fail to respond to the ticket within a set period of time, you will be found guilty and sentenced to the fine on your ticket (you may also have some additional minor court costs.)

If you have received a summons, you must appear at the time, date and place listed on your ticket or hire an Agent (paralegal or lawyer) to appear on your behalf. You cannot simply "pay the fine". If you fail to appear in Court, the Court will usually set a date for your trial to take place without you. In such a case, the trial will proceed, the officer will testify, and usually you will be found guilty. Since nobody is there on your behalf, the penalty is awarded at the discretion of the prosecutor subject to the approval of the Court and the requirements of the relevant statute law.
