Ilham I.’s Case, Ottawa

Charges: Dangerous Driving
Result: Case Dismissed

Case Details

One day this client, who had no driver's licence, was asked by a friend to drive home when her friend felt ill.

The two arrived at a convenience store and the friend and the accused's daughter went inside. The accused got out of the car and got back in on the driver's side. She then put the car into gear, however did not realize that she had the car in reverse. When she pressed the gas, she shot backwards and went through the glass window of the store, and into the store.

The Crown sought a conviction and sought to give Ilham a criminal record. David Anber took this case on while he was still in law school. At the trial, the Judge agreed with Mr. Anber's argument that this was just an accident and not an example of dangerous driving no matter how much damage had been caused and despite the danger posed to people inside.
