Case Details

This mild mannered young man was asked by his sister’s “friend” to drive a car to Toronto and drop it off for another “friend”. He agreed.

While driving through Brockville his car was stopped and searched and the client was arrested.

When the trunk was searched 26 pounds of mj was found packaged in the back.

At trial, Mr. Anber challenged the officer’s grounds for the search and argued two other defences afterwards. Unfortunately the judge convicted the accused and sentenced him to 3 months in jail.

On appeal to the Ontario Court of Appeal (Ontario’s highest Court, just below the Supreme Court) agreed that a new trial should be ordered due to improper decisions made by the trial judge.
