Case Details

Alex S was represented by David Anber at trial and again on Appeal. The charge was failing to change lanes for stopped emergency vehicle. At trial a Justice of the Peace known for delivering this exact verdict considered the competing evidence of the police officer and the accused. He found that while neither version was untrue one of them was “slightly more accurate” that being the version of the police officer. On Appeal, Anber argued that the Supreme Court’s decision in W.D. was not respected and therefore an acquittal should be entered. This was upheld.
