The accused in this case stole nearly 5000 dollars from the place where he worked as a manager. Typically theft from one’s employer (breach of trust theft) is the kind of case where the person almost always has a serious look at going to jail even without a prior record. In this particular case, the client saw David Anber after he had fired his previous lawyer who had told him it would be impossible to avoid getting a criminal record.
Mr. Anber worked with the client, who had stolen the money due to a gambling addiction so that the client sought the help he needed.
When Mr. Anber presented this to the Court, the sentencing Judge agreed that this could be a rare case where no criminal record would be needed to protect the public interest.
